OFFICIAL RULES

NO PURCHASE IS NECESSARY TO ENTER OR WIN THE CONTEST AND A PURCHASE WILL NOT INCREASE CHANCES OF WINNING.

1. Eligibility: This Contest is offered only in the United States and only in the Sponsor’s current service areas, and is void in Puerto Rico, outside the United States, in locations outside of Sponsor’s service areas, and anywhere else prohibited by law. This Contest is open to legal residents of the United States who are at least 18 years of age at the time of entry. Employees, directors and all household (whether related or not) and immediate family members of Bathcrest, Inc., its affiliates, franchisees, agents, advertising and promotional agencies or any entity involved in the development, product implementation or administration of the Contest are not eligible to participate or win. BY ENTERING, YOU AGREE TO THESE OFFICIAL RULES AND THE DECISIONS OF SPONSOR, WHICH ARE FINAL AND BINDING IN ALL RESPECTS.
2. Entry: Only one entry per household will be accepted. To enter, complete the entry form and return to the Sponsor. Entry forms may be obtained directly from the Sponsor or on-line at www.bathcrest.com/contest. [Need correct URL.] Subsequent entries in the same prize period will be disqualified. The submission is the sole responsibility of the entrant. Only entry forms actually received by the Sponsor will be included in the Contest. Proof of sending does not constitute proof of actual receipt by the Sponsor. Illegible, forged, altered, incomplete or otherwise unintelligible entry forms will be disqualified. The Sponsor is not responsible for late, lost, misaddressed or not received entry forms, in each case due to any reason whatsoever. All entries become the property of the Sponsor and none will be acknowledged or returned. By submitting an entry, you agree that you would like to received more information about Sponsor. (You may subsequently opt-out of the receipt of such information at any time by notifying Sponsor. Opting out during the Contest period, however, will forfeit your entry in the Contest.)
3. Prize: The prize for this Contest is a bath and wall liner system, installed. The approximate retail value is $3,700. Prize is nontransferable and must be accepted as awarded. Offer may not be combined with other promotional offers or discounts. Prize is subject to inspection and ability to complete job. Prize cannot be exchanged, returned, or redeemed for cash. No substitutions or rain checks. Sponsor reserves the right, in its sole and absolute discretion, to substitute a prize of equal or greater value.

5. Contest Period: One winner will be selected on July 1, 2008. Entries will be eligible only for the drawing to be conducted during the period the entries are received.
6. Winner Selection and Notification: Winners will be notified by U.S. mail. Odds of winning depend upon the number of valid entries received. Prize selection per winner will be selected by random drawing. Winners will be required to complete and return an affidavit of eligibility, a liability release, and where lawful, a publicity release, and other required information within 15 days of notification. Failure to respond timely, or if prize notification is returned as non-deliverable, or if winner is found not to be eligible or not in compliance with these Official Rules, disqualification will result and an alternate winner will be selected. All taxes, including federal, state and local taxes are the sole responsibility of winner. If required by law, winner will be issued an IRS 1099 tax form (winner is advised to seek independent counsel regarding prize winnings).
7. General Conditions: By accepting prize, where permitted by law, winners grant to Sponsor, and those acting pursuant to Sponsor’s authority (and winners agree to confirm said grant in writing) the perpetual, fully paid, worldwide right to use and publish his/her name, portrait, picture, voice and likeness for advertising, trade and promotional purposes without additional consideration, in any media, format, including without limitation on the Internet, without notification, review or approval. Further, participants release and agree to hold harmless Sponsor, its affiliates and franchisees, and their respective directors, officers, employees, representatives and agents from any and all liability for any injury, loss or damage of any kind to person, including death, and property, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of the prize, participation in any Contest related activity, or participation in this Contest.
   
   Sponsor reserves the right, in its sole and absolute discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or website; to be acting in violation of the Official Rules; to be acting in violation of the terms of the website, or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.
8. Disputes: Entrant agrees and accepts that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, other than those concerning the administration of the Contest or the determination of winners, shall be resolved individually, without resort to any form of class action, and exclusively by the state or federal courts in Salt Lake County, Utah; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees or court costs; and (iii) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental, special and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Utah, without giving effect to any choice of law or conflict of law rules.

10. We strive to ensure all information is accurate and up-to-date and any errors or omissions and will be subject to correction without prior notification.
11. Prior winners are ineligible for prizes within a two-year period of any previous win.
12. Sponsor reserves the right to terminate or modify this promotion at any time without prior notice.
